Acceptable Use Policy

Eusend is shared sending infrastructure. One account sending spam or abusive mail can harm deliverability for everyone else on the platform, so we hold every sender to the rules below. This policy is part of, and supplements, our Terms of Service. Breaking it can lead to throttling, suspension, or termination — immediately and without notice where necessary to protect the platform.

1. The one rule behind all the others

Only email people who have asked to hear from you. Every recipient you send to must have given you clear, verifiable permission — a signup, a purchase, an account, or another direct relationship where they knowingly gave you their address for this purpose. If you cannot show how someone opted in, do not email them through eusend.

Permission is specific to you. Purchased, rented, scraped, appended, or otherwise third-party lists are never acceptable, even if the addresses once opted in somewhere else.

2. Prohibited sending practices

You may not use eusend to:

  • Spam. Send unsolicited bulk or commercial email of any kind, including cold outreach and mail to purchased or harvested lists.
  • Phish or impersonate. Pose as a person, brand, or organization you are not, or attempt to obtain credentials, payment details, or other sensitive information under false pretenses.
  • Distribute malicious content. Send malware, viruses, ransomware, or links to compromising or deceptive downloads.
  • Harass or threaten. Send messages that are threatening, intimidating, defamatory, or that promote violence or hatred against people or groups.
  • Break the law. Send anything that violates applicable law, including the GDPR, the ePrivacy Directive, national anti-spam rules, sanctions, or export controls.
  • Evade our controls.Create multiple accounts, or use another party's account, to get around sending limits, suspensions, abuse protections, or reputation monitoring.
  • Interfere with the service.Attempt to disable, overburden, probe, or impair eusend's infrastructure, or bypass its authentication and rate limits.

3. Prohibited and restricted content

Some categories of mail draw disproportionate spam complaints and abuse, and damage the shared sending reputation regardless of consent. You may not send content that promotes, advertises, or relates to:

  • Illegal goods, services, or activities
  • Sexually explicit material, escort, or adult dating services
  • Pharmaceuticals, controlled substances, or unregulated health “cures”
  • Gambling, betting, or lotteries
  • Multi-level marketing, pyramid schemes, affiliate-only mailings, and “get rich quick” or quick-money offers
  • Payday loans, debt relief, credit repair, and similar high-risk financial offers
  • Cryptocurrency speculation, token sales, and trading “signals”
  • List brokering, lead selling, or the sale of email addresses
  • Fake or paid engagement — social media followers, reviews, likes, or comments
  • Any content designed to deceive recipients or mailbox providers

If your legitimate business touches one of these areas, contact us before you start sending at [email protected] rather than assuming it is allowed.

4. Mailing-list requirements

Every message you send must:

  • Go only to recipients who explicitly opted in to hear from you
  • Accurately identify you as the sender, including a valid physical mailing address for commercial mail
  • Make clear why the recipient is being contacted
  • Offer a working, one-click unsubscribe on every marketing message and honor opt-outs promptly
  • Use truthful subject lines and headers — no deceptive routing or “from” addresses

Eusend adds one-click List-Unsubscribe headers and manages suppression lists for you, but the underlying consent and accuracy are always your responsibility as the sender.

5. Sending quality and reputation

Consistently high bounce rates, spam complaints, or spam-trap hits signal poor list quality and put every sender on the platform at risk. Keep your bounce and complaint rates low by mailing only engaged, opted-in recipients and removing addresses that bounce or complain.

We monitor these signals continuously. If your account exceeds healthy thresholds, we may throttle your sending, require you to re-verify your list, or suspend the account while we investigate — see our Security practices for how we watch for abuse.

6. Enforcement

We investigate reports of abuse and act on the signals above. Depending on severity, we may warn you, throttle or pause sending, suspend the account, or terminate it. Where an account threatens the deliverability or integrity of the platform, or is being used for phishing, fraud, or illegal content, we will act immediately and without prior notice.

We may also be legally required to report certain content to the relevant authorities.

7. Reporting abuse

If you received unwanted or abusive email sent through eusend, or believe an account is violating this policy, tell us at [email protected]. Include the message headers where you can — they help us trace and stop the sender quickly.
